Lipodrene FDA and Lawsuits

Hi-Tech Pharmaceuticals has a history of controversy. In 2008, Hi-Tech Pharmaceuticals was barred from making misleading statements about their diet supplements. They also had to warn consumers about the potentially dangerous ingredients in their products. According to the Federal Trade Commission, they ignored the court order and had to pay $40 million in damages to consumers.

In 2009, the High-Tech CEO, vice president, and founder were all sentenced to 18 months in prison to run an illegal online pharmacy. According to NBC News, the trio could have served up to 20 years, but they reached a plea with the prosecution. The plea deal allowed Jared Wheat, High-Tech’s CEO, to remain in charge of the company.

In 2015, the FDA contacted Hi-Tech Pharmaceuticals concerning information that BMPEA was found in Fastin-XR and Lipodrene Extended Release. The FDA demanded that Hi-Tech remove the ingredient from all supplements. Hi-Tech refused to comply.

Instead of complying with the FDA, Jared Wheat sued the Harvard researcher, who initially found the illegal substance in Hi-Tech Pharmaceutical supplements. Wheat claimed the negative press his company was receiving should be considered libel.

According to a Business Insider report, the Harvard researcher, Dr. Pieter Cohen, won the case, but the trial was long and expensive. Critics saw the frivolous lawsuit as a way for Wheat and Hi-Tech Pharmaceuticals to intimidate other academics investigating the growing supplement industry.

On April 10, 2019, the FDA sent another warning letter to Hi-Tech Pharmaceuticals. The letter addressed concerns that several Hi-Tech supplements contain another potentially dangerous ingredient. Lipodrene Elite, HydroxyElite, and Ultimate Orange all have Dimethylhexylamine.

Dimethylhexylamine may cause serious side effects similar to those of dimethylamylamine. Dimethylamylamine is capable of generating a heart attack or stroke in previously healthy individuals.

Instead of complying, Jared Wheat and Hi-Tech Pharmaceuticals sued the FDA. On May 3, 2019, filed a lawsuit against the FDA for intimidation. In June 2019, the FDA was ordered to return five truckloads of DMAA to Hi-Tech.

However, in an exciting twist, the FDA was notified it had properly seized the DMAA ingredient on August 30, 2019. This was because DMAA is a food additive, not a dietary supplement, as Hi-Tech had argued.

Unfortunately, the company has continued to get into trouble with the law. Although Hi-Tech Pharmaceuticals already received a warning from the FDA regarding dimethylamylamine (DMHA), the company continued to use it.

On November 2, 2019, the company was sued for using DMHA in a long list of supplements, including Ultimate Orange, Fastin-XR, Lipodrene Elite, Lipodrene Hardcore, Lipodrene Xtreme, and Hydroxyelite.

On May 19, 2020, the FTC started issuing $8.5 million in refund checks to consumers who bought Lipodrene, Spontane-ES, and Thermalean due to the supplements making fraudulent claims.

Lipodrene and the FDA

On May 12th, 2021 the FDA issued a voluntary recall on Lipodrene because of the presence of dimethylamylamine (DMAA). According to the FDA, DMA is dangerous because it narrows blood vessels and arteries which can cause a cardiovascular problems like a rise in blood pressure, shortness of breath, arrhythmias, elevated blood pressure, tightening in the chest, and heart attack.
